Terms of Service

1. Acceptance of Terms

By creating an account or otherwise accessing Jobpaq (the “Platform”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. These Terms form a legally binding agreement between you and Jobpaq LLC (“Jobpaq,” “we,” “us,” or “our”), a limited liability company incorporated in Washington State, United States. If you do not agree to these Terms, you must not use the Platform. You must be at least 18 years old to create an account.

2. Description of Service

Jobpaq is an online hiring marketplace that connects job seekers (“Candidates”) with companies looking to hire (“Employers”). The Platform allows Candidates to create profiles and resumes, search and apply to job postings, communicate with Employers, track application status, and schedule interviews. Employers can post vacancies, review applications, message Candidates, manage interviews, and pay for posting visibility. Jobpaq acts solely as a venue; we are not a party to any employment relationship that arises between Candidates and Employers.

3. User Accounts

You may register using your email address. We authenticate access via one-time codes sent to your email and passkeys (WebAuthn credentials) stored on your device.

• You must provide a valid email address and keep your account information accurate and current.
• You are responsible for maintaining the security of any passkeys or devices used to access your account.
• You are responsible for all activity that occurs under your account. Notify us immediately at legal@jobpaq.com if you suspect unauthorized access.
• You may not share your account or transfer it to another person.

4. User Types and Roles

The Platform has two primary user types:

• Candidates — individuals seeking employment. You may create resumes, apply to postings, message Employers, save favorite postings, and manage interview scheduling through the Platform.
• Employers— companies or individuals hiring for roles. You may create an organization profile, post vacancies, and manage applications, interviews, and messaging. Employers may add team members (“Managers”) who act on behalf of the Employer account.

By accepting these Terms as an Employer, you represent that you have authority to bind the organization you represent to these Terms. Managers inherit the permissions of the Employer account and are bound by these Terms individually.

5. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent job listings, applications, resumes, or profile information.
• Harass, threaten, discriminate against, or abuse any other user.
• Use the Platform to collect personal data about other users without their consent, or to build competing products or services.
• Scrape, crawl, or use automated means to access or extract data from the Platform without our express written consent.
• Upload or transmit malware, viruses, or any code intended to damage or disrupt the Platform or its users' systems.
• Attempt to circumvent authentication, access controls, or security features of the Platform.
• Violate any applicable law, including employment discrimination laws, data protection regulations, or consumer protection rules.
• Use the Platform to send unsolicited commercial messages or spam.

6. Job Listings and Applications

Jobpaq does not screen, verify, or guarantee the accuracy, legality, or quality of job postings submitted by Employers. We do not guarantee that any Candidate will receive an interview or job offer, nor that any posting will attract qualified applicants. All hiring and employment decisions are made solely between Candidates and Employers. Jobpaq is not liable for any outcome of those decisions.

7. Payments and Fees

Candidate accounts are free. Employers pay fees to publish job postings. All payments are processed securely by Stripe, Inc.

• Fees and pricing are displayed at the time of purchase and are quoted in US dollars unless stated otherwise.
• Payment is due at the time of checkout. By completing a purchase, you authorize Jobpaq (through Stripe) to charge your payment method for the amount shown.
• Fees paid for published postings are non-refundable once the posting goes live, except where required by applicable law or at our sole discretion in cases of technical error.
• You are responsible for all taxes applicable to your purchases. Jobpaq will collect applicable sales or VAT taxes where required by law.
• Jobpaq may change its fees at any time by posting updated pricing on the Platform. Changes do not apply to purchases already completed.

Payment method information (card brand, last four digits, expiry) is stored by Stripe. Jobpaq does not store full card numbers. Your use of Stripe's services is subject to Stripe's Services Agreement.

8. User Content

“User Content” means any content you submit to the Platform, including resumes, profile information, job descriptions, compensation details, and messages.

• You retain ownership of your User Content.
• By submitting User Content, you grant Jobpaq a worldwide, royalty-free, non-exclusive license to store, process, display, and transmit that content solely as necessary to operate and improve the Platform.
• You represent that you have all rights necessary to submit your User Content and that it does not infringe the rights of any third party.
• We do not sell your User Content to third parties for advertising purposes.

9. Communications and Notifications

By creating an account, you consent to receive transactional communications related to your account and the Platform (e.g., authentication codes, application status updates, new messages) via email and, where you have provided a phone number and enabled the option, via SMS. You can manage your notification preferences at any time from your profile settings. Disabling a notification channel does not affect our ability to send you communications required by law or for account security purposes.

10. Intellectual Property

The Jobpaq name, logo, and all Platform software, design, text, and graphics (excluding User Content) are owned by or licensed to Jobpaq LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written permission.

11. Privacy and Data

Your use of the Platform is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. The Platform uses Sentry for error monitoring, which may collect technical diagnostic data. By using the Platform, you agree to our Privacy Policy.

12. Termination

Either party may terminate the relationship under these Terms at any time.

• You may close your account at any time by contacting us at legal@jobpaq.com.
• We may suspend or permanently terminate your account if we determine, at our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or the Platform.
• Upon termination, your right to access the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes (such as fraud prevention), as described in our Privacy Policy.
• Employers with active paid postings will not receive refunds upon voluntary account closure unless the posting has not yet gone live.

13. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY SPECIFIC EMPLOYMENT OUTCOMES FOR CANDIDATES OR HIRING RESULTS FOR EMPLOYERS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBPAQ LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO JOBPAQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless Jobpaq LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Platform, your User Content, or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.

For any dispute, claim, or controversy arising out of or relating to these Terms or the Platform, you agree to first contact us at legal@jobpaq.com to attempt informal resolution. If we cannot resolve the dispute informally within 30 days, either party may bring a claim in the state or federal courts located in King County, Washington, and both parties consent to personal jurisdiction in those courts.

Notwithstanding the above, nothing in these Terms prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email to the address associated with your account at least 14 days before the changes take effect, or longer where required by law. The updated Terms will be posted on this page with a new effective date. If you continue to use the Platform after the changes take effect, you agree to the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may close your account.

18. Miscellaneous

• Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jobpaq LLC regarding the Platform and supersede all prior agreements.
• Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
• Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
